POINT ZERO PRIVACY POLICY

This website is owned and operated by Point Zero Training Pty Ltd (“Point Zero”). This Privacy Policy (“Policy”) provides details on how Point Zero collects and uses Personal Data when you access our Site or use our product(s) and/or service(s) included but not limited to smart phone apps and profiles on social media platforms used by Point Zero.

This Policy does not include Personal Data that may be collected by third parties such as websites linking to or from our Site, or other businesses or individuals that Point Zero does not own, control, employ or manage. 

We will not disclose any collected Personal Data except where stated herein or otherwise notified in advance.

If you do not agree with our Priavcy Policy, do not: access or use any of our Sites, provide information to us, or use our product(s) or service(s).

This Privacy Policy operates together with our Site’s Terms and Conditions. 

Definitions

Unless otherwise defined, words used in this Policy shall take on the following definition:

“Point Zero”, “we” or “our” means Point Zero Training Pty Ltd.

“Personal Data” means information that makes it identifiable or locatable to an individual, such as name, postal address, email address, telephone number.

Collection of Personal Data

Point Zero collects Personal Data with your specific prior knowledge and consent, such as when you create an account with us, make a purchase with us, sign up to a membership, subscribe to our newsletter, complete a survey or to enter giveaways. 

This information may include your contact information such as your legal name, email address, telephone number, residential address, as well as personal information such as medical related information including any injuries or medication you may be taking. You may elect not to provide us with any personal information. 

When you make a purchase with us or provide us with your payment details for any reason, you provide your payments details to a third party payment processing system. Your payment details and other details are managed in line with that third party’s privacy policy. 

We may also use cookies to enable us to collect data that may include personal information. For example, where a cookie is linked to your account, it will be considered personal information under the Privacy Act. We will handle any personal information collected by cookies in the same way that we handle all other Personal Data as described in this Privacy Policy.

We may retain personal information in our electronic archival or backup system.

How We Use Personal Data

We use, store and/or provide your Personal Data to conduct our business activities, such as to:

(a)        Enhance or improve user experience of our Site, or help improve performance of our product(s) or service(s) offered through on our Site;

When you post, contribute or share content to our social media, any of our app’s public areas, including but not limited to any comments section, depending on the forum, your submitted content may be public. We recommend you exercise caution when you post, contribute or share contents on our public areas in order to protect your personal privacy.

We shall not be held liable for any and all claims, losses and damages sustained or resulting from any misuse of our Sites, breach on any of our Sites’ terms and conditions, any contents you submit onto our Sites, or unauthorized use of your account.

Automatic Collation of Data

Our servers may automatically collect automatic, individual and/or aggregate information about your electronic device (such as phone, computer) used to visit our Site, such as the website that referred you, Internet Protocol (“IP”) address, type and configuration of the internet browser of your electronic device, browsing preference such as language settings, font size, geo-location, operating system, and other usage and traffic information.

Point Zero uses this automatic, individual and/or aggregate information to analyse trends, gather and prepare statistics or demographic information and administer our Site so we may provide improved online web experiences to our users and visitors.

Information collected may not identify you personally. We may provide such information (not necessarily personal data) to our partners about how our users collectively use our Site in order to provide you with an improved web experience.

We may also be legally required to disclose or provide access to our database to comply with applicable laws, regulations, court order and/or request from government authority.

This Policy does not restrict or limit our collection and use of such automatic and/or aggregated information.

Third Party Websites

Our Site may contain links to third party websites, advertisers or services that we do not own or control. We assume no responsibility for the content, privacy policies or practices of any third party websites, advertisers or services or their use of your Personal Data. If you access a third party website from our Site, you do so at your own risk, and you understand that neither this Policy nor our Terms and Conditions apply to your use of such third party sites. You authorise Point Zero to provide your Personal Data to any third parties we may hire, contract, instruct or otherwise retain services for the purpose of operating, hosting, maintaining, repairing, improving, preserving or otherwise dealing with our Site or its underlying files or systems, for data processing on our behalf, provide technological support and/or conduct maintenance of our servers, data banks or database. Point Zero shall not be held liable for any actions undertaken by such third parties.

Marketing & Communication

By registering an account with Point Zero through our website or smartphone app, you will receive promotional and direct marketing materials and/or updates by way of email, push notification, text message or social media message from Point Zero. If you elect to opt-out from these communications, you may do so at any time by using the unsubscribe link at the bottom of the e-mail or text message.

We will use your Personal Data for our direct marketing. We will not use or provide your Personal Data to third parties for direct marketing unless we have obtained your explicit consent.

Law Enforcement

We may disclose your Personal Data to a third party to comply with any applicable laws, regulations, court order and/or request from government authority, without notice to you as applicable. 

Security of Information

We use SSL and TLS certificates to help secure our Site. However, we make no representations as to the security or confidentiality of your Personal Data. You understand and agree that no transmission of data over the internet is guaranteed to be completely secure. Request for Personal Information

We reserve the right to refuse deletion of Personal Data if we or our service provider(s) consider the data is required to be retained in order to:

(d)        exercising free speech, and to ensure the right of free speech of a business or another individual;

(e)        Conduct research (whether for public, scientific, historical, statistical) which adheres to other applicable ethical and privacy laws;

(f)         Internal use which is reasonably aligned with consumer expectations based on consumer’s relationship with Point Zero, or in a lawful manner which aligns with the context and reason for why personal information was provided;

(g)        Comply with the Privacy Act; or

(h)        Otherwise comply with legal obligations.

Amendments

We may amend this Privacy Policy from time to time with no notice to you. The amended version will be published on our website in place of the previous version. Changes in this Privacy Policy become effective as soon as the changes are published on our Site. If you continue to use our Site after the changes become effective, it represents your agreement to be bound by such changes.

If you do not agree with the revised or updated Privacy Policy, you must immediately cease using our Site and product(s) and service(s).

Validity

If any of the provisions in this Privacy Policy are held to be invalid or unenforceable for any reason by a court of competent jurisdiction, such provision(s) shall be deemed as severed from this Policy. Such unenforceability or invalidity shall not in any way affect enforceability and/or validity over the remaining provisions of this Policy, which shall continue in full force and effect.
